Court matter about admissions � obfuscating CSS?

The same issue seems sub-judice on two different DBs
in Delhi High Court. A Public Notice issued by GNCT in
connection with a writ (appeal) and the letter sent to
respondents (including GNCT) in the MPISG matter
seeking enforcement of Delhi Master Plan provisions
for a holistic schema for equal access neighbourhood
school / common school system is here.

PUBLIC NOTICE
It is notified for the information to the general
public and particularly to the Managing Committees of
all Recognized Unaided Schools that the Division Bench
of High Court Comprising Hon?ble Mr. Justice Dalveer
Bhandari and Hon?ble Mr. Justice R.C.Jain on 6.5.2004
in Writ (Appeal) No.196/2004 in the matter titled Sh.
Rakesh Goel & Ors V/s Mont Fort School & Ors, has
issued directions to the Director of Education, Govt.
of NCT of Delhi at the directions recognized Unaided
Schools who are willing to assist the Court, may
remain present on 21st May, 2004 and address the
Hon?ble Court on the points raised in the said appeal.
The points for the determination are as follows:
1. Whether the criteria of holding tests and
interviews for children for admission to Nursery /
Lower KG / KG and Class-I is and also interviewing the
parents by the schools for admission of their wards is
justified?
2. Criteria of admission should be fixed to ensure
admission of the children to a 'Neighbourhood School'
rather than making them travel to schools situated at
far flung distances.
3. The children of poor and uneducated parents have
equal rights of admission of their wards in the
schools as compared to the rights of the Children of
highly educated parents with affluent background.

and (copy of) my letter of 04.05.2004

Dear Madam,

The Public Notice under reference says "the Division
Bench of High Court comprising Hon'ble Mr Justice
Dalveer Bhandari and Hon'ble Mr Justice R.C.Jain on
6.5.2004 in Writ (Appeal) No. 196/2004 ? has issued
directions to the Directorate of Education, Govt. of
NCT of Delhi at the recognized Unaided schools who are
willing to assist the Court, may remain present on
21st May, 2004". The points for the determination
enumerated ? justifiability of holding tests and
interviews for admissions, fixing criteria for
admission to ensure admission to 'Neighbourhood
School' and rights of children of poor and uneducated
parents ? are also covered by the equal access
neighbourhood schools' provisions of Delhi Master
Plan.

You are requested to ensure that these statutory
provisions -- binding under Delhi Development Act,
1957, and modifiable only by due process of its s.11A
-- are brought to the attention of the Hon'ble Court,
along with the fact of their enforcement being subject
of the above-mentioned petitions (in which GNCTD is
respondent no.3) being heard by the Division Bench
comprising Hon'ble Chief Justice and Hon'ble Justice
Ahmed.
