Police support for pushta demolitions

Pushta demolitions stand out from others on account of
amount of police deployment. The demolitions are
following procedures in violation of law, policy,
court orders and EC directive and are unworthy of
legitimacy, forget protection, by police. After the
meeting with EC officials on 16.03.04, a letter was
delivered in Police Commissioner Office on 17.03.04 at
9:45 AM. The receipted copy was taken to the site
where demolition had commenced and police officers
declined to do anything about it. EC officials were
informed of the precipitate action. At about 1 PM a
meeting with SO to Police Commissioner was secured and
he has also said the matter will be looked into.

Sub: Complaint against disregard by authorities of
law, policy and directions of court and commission at
Gautam Puri

You are aware, Hon?ble High Court has directed
clearance of Yamuna Pushta on 03.03.03 and passed a
number of orders thereafter in the matter and Hon?ble
Election Commission has directed authorities to
provide it information necessary for ensuring that
voter rights are protected in course of compliance
with court orders. Obviously, neither the Court nor
the Commission has given authorities permission for
coercive action in disregard of law and policy and
their directions. However, MCD, with police support,
is doing precisely this in Gautam Puri, as under:
1. A ?notice? in form of posters is pasted in various
places. It is dated 15.03.04 and mentions demolition
on 17/18.03.04. This is, besides being at variance
from usual notice procedure, violative of s.30 of
Delhi Development Act, 1957, requiring minimum 5 days,
2. Survey lists of 75 eligible for 18 sqm plots and
153 eligible for 12.5 sqm plots have been pasted. As
per policy these require payment of, respectively, Rs
7000 and Rs 5000. However, also from 153 required to
pay as per policy only Rs 5000 an amount of Rs 7000 is
being taken / extorted.
3. Megaphone announcements have been made to offer
option of paying half of Rs.7000 share money. This is
in disregard of High Court order of 30.01.04 that
directed that any one making down payment of Rs.500 or
more will be entitled to parchi.
4. While there are well over a thousand families, only
228 are listed on survey list. The rest are unable to
ascertain what the Election Commission has directed
for them and lack of transparency on this count is
clearly in violation of any EC directive in the

All the aforementioned violations are taking place
amidst massive deployment of police force, inclusive
of barricading entrances and restricting people from
entering the settlement or even meeting in groups to
discuss the situation, with ?free trucks?
conspicuously parked and being used to force
?voluntary relocation?. All this unlawful and
highhanded activity going on at public expense amounts
to coercive action in disregard of law, policy, court
and commission and is serving, among other things, to
undermine public confidence in courts and commission,
in whose name it is being falsely justified in media,
as well as in police.

Kindly take immediate action to stop all this and to
ensure that clearance of Pushta progresses according
to law and in orderly manner befitting the capital of
the world?s largest democracy.
