DDA barred from building in Motia

Displeased by the failure of the authorities to construct a multi-level car park in Motia Khan area of the Capital, the High Court has restrained the Delhi Development Authority (DDA) and the Municipal Corporation of Delhi (MCD) from carrying out any construction activity in the area till further orders.

Delivering the restraint order, a Division Bench of Chief Justice B C Patel and Justice S K Kaul also sought status reports from the DDA, the MCD, the Government of Delhi and the Traffic Police in this regard within two weeks.

The order came on a PIL filed in 2003 by Paharganj Timber and Plywood Traders Association, which alleged that the local authorities have not constructed a multi-level parking lot at plot No 5 of the six-acre land owned by the DDA in Motia Khan.

The area was earmarked for the purpose. Petitioner’s counsel Pawan Bindra had submitted that the traders/shopkeepers were facing problems of parking and there was traffic congestion due to the non-availability of parking space in the area.

The court turned down DDA counsel Rajiv Bansal’s plea not to pass the restraint order, and give more time to the agency for building the car park. It said unless such an order was passed, the DDA officials would not pay any heed to it.

The court took exception to the DDA’s plan to construct some shops in the area earmarked for the multi-level parking lot.
