\par Procedure for preparation of Master Plan

\par 5. Public Notice regarding preparation of Master Plan
\par \endash (1) As soon as may be after the draft master plan has
\par been prepared, the Authority shall publish a public
\par notice stating that:
\par (a)The draft master Plan has been prepared and may be
\par inspected by any person at such time and place may be
\par be specified in the notice
\par
\par (b)Suggestions and objections in writing, if any, in
\par respect of the draft master plan may be filed by any
\par person with the secretary of the Authority within 90
\par days from the date of first publication of the notice.
\par
\par (2) This notice may be in Form \lquote A\rquote appended to these
\par rules without modification with such modification as
\par may be necessary.
\par
\par 6. Mode of Publication of Public Notice \endash The
\par Authority shall cause the said notice to be published
\par in the manner prescribed by section 44 of the Act and
\par may also cause it to be published in the Official
\par Gazette.
\par
\par 7. Notice to and representation from local authorities
\par \endash The Authority shall cause a copy of the notice
\par referred to in Rule 6 to be sent every local authority
\par within whose limits any land touched by the plan is
\par situates, and such local authority may, within a
\par period of 90 days from the date of the notice, make
\par any representatin with respect to the plan to the
\par Authority.
\par
\par 8. Appointemnt of Board for enquiry and hearing \endash (1)
\par The Authority shall, for hearing and considering any
\par representation, objection and suggestion to the draft
\par master plan, appoint a Board consisting of not less
\par than 3 and not more than 5 members of the Authority.
\par \tab Provided that such Board shall have power to co-opt
\par not more than 2 members from amongst the members of
\par the Advisory Council.
\par
\par (2) No business of the Board shall be transacted at
\par any meeting unless at least three members are present
\par from the beginning to the end of the hearing.
\par
\par 9. Enquiry and hearing \endash The secretary shall, after
\par the expiry of the period allowed under these rules for
\par making objections, representations and suggestions,
\par fix a date or dates for hearing by the Board of any
\par person, or local authority in connection with any
\par objection, representation or suggestion made by such
\par person or local authority or any person who may be
\par allowed a personal hearing in connection with such
\par representation, objection or suggestion to the draft
\par master plan, a notice intimating the time, date and
\par place of the hearing.

\par 10. Report of Enquiry \endash The Board shall after the
\par conclusion of its enquiry, submit to the Authority a
\par report of its recommendations.

\par 11. Preparation of final draft Master Plan and its
\par submission to Central Government - The Authority
\par shall, after considering the report of the Board and
\par any other matter it thinks fit, finally prepare the
\par master plan and submit it to the Central Government
\par for its approval.
\par
\par 12. Amendment of Master Plan \endash The Authority may amend
\par the whole or any part of the master plan, if
\par necessary. at the expiry of every five years in
\par accordance with the procedure prescribed by the Act
\par and these rules as if the proposed amendment were a
\par new master plan.
\par
\par \tab Provided that if the Authority is of the opinion that
\par having regard to the circumstances prevailing at any
\par particular time it is necessary so to do, it may amend
\par the master plan or any part thereof at any time prior
\par to the expiry of the said period, in accordance with
\par the aforesaid procedure.
\par
\par \tab Provided further that the Authority may, without
\par following the aforesaid procedure, but with the prior
\par approval of the Central Government, permit on receipt
\par of an application in this behalf, any change in the
\par size of public parks and recreation grounds not
\par exceeding ten per cent either way of the approved
\par size.
\par
\par 13. Approval of Central Government to amendment of
\par master plans - (1) amendment of the master plan shall
\par take effect unless approved by the Central Government.
\par (2) Immediately after an amendment has been approved
\par by the Government the Authority shall publish it in
\par such manner as may be prescribed by regulations a
\par notice stating that the amendment has been approved
\par and naming a place where a copy of the amendment may
\par be inspected at all reasonable hours and upon the date
\par of the first publication of the aforesaid notice the
\par amendment shall come into operation.

\par CHAPTER III
\par Procedure for preparation of Master Plan
\par
\par 5. Public Notice regarding preparation of Master Plan
\par \endash (1) As soon as may be after the draft master plan has
\par been prepared, the Authority shall publish a public
\par notice stating that:
\par (a)The draft master Plan has been prepared and may be
\par inspected by any person at such time and place may be
\par be specified in the notice
\par
\par (b)Suggestions and objections in writing, if any, in
\par respect of the draft master plan may be filed by any
\par person with the secretary of the Authority within 90
\par days from the date of first publication of the notice.
\par
\par (2) This notice may be in Form \lquote A\rquote appended to these
\par rules without modification with such modification as
\par may be necessary.
\par
\par 6. Mode of Publication of Public Notice \endash The
\par Authority shall cause the said notice to be published
\par in the manner prescribed by section 44 of the Act and
\par may also cause it to be published in the Official
\par Gazette.
\par
\par 7. Notice to and representation from local authorities
\par \endash The Authority shall cause a copy of the notice
\par referred to in Rule 6 to be sent every local authority
\par within whose limits any land touched by the plan is
\par situates, and such local authority may, within a
\par period of 90 days from the date of the notice, make
\par any representatin with respect to the plan to the
\par Authority.
\par
\par 8. Appointemnt of Board for enquiry and hearing \endash (1)
\par The Authority shall, for hearing and considering any
\par representation, objection and suggestion to the draft
\par master plan, appoint a Board consisting of not less
\par than 3 and not more than 5 members of the Authority.
\par \tab Provided that such Board shall have power to co-opt
\par not more than 2 members from amongst the members of
\par the Advisory Council.
\par
\par (2) No business of the Board shall be transacted at
\par any meeting unless at least three members are present
\par from the beginning to the end of the hearing.
\par
\par 9. Enquiry and hearing \endash The secretary shall, after
\par the expiry of the period allowed under these rules for
\par making objections, representations and suggestions,
\par fix a date or dates for hearing by the Board of any
\par person, or local authority in connection with any
\par objection, representation or suggestion made by such
\par person or local authority or any person who may be
\par allowed a personal hearing in connection with such
\par representation, objection or suggestion to the draft
\par master plan, a notice intimating the time, date and
\par place of the hearing.
\par }\pard \sl360\slmult1\nowidctlpar\widctlpar{\*\pn \pnlvlcont\ilvl0\ls0\pnrnot0\pndec }\adjustright {\i
\par }\pard \li1985\sl360\slmult1\nowidctlpar\widctlpar{\*\pn \pnlvlcont\ilvl0\ls0\pnrnot0\pndec }\adjustright {\i \tab Provided that the Board may disallow personal hearing
\par to any person, if it is of the opinion that the
\par objection or suggestion made by such person is
\par inconsequential, trivial or irrelevant.
\par
\par 10. Report of Enquiry \endash The Board shall after the
\par conclusion of its enquiry, submit to the Authority a
\par report of its recommendations.
\par
\par 11. Preparation of final draft Master Plan and its
\par submission to Central Government - The Authority
\par shall, after considering the report of the Board and
\par any other matter it thinks fit, finally prepare the
\par master plan and submit it to the Central Government
\par for its approval.
\par
\par 12. Amendment of Master Plan \endash The Authority may amend
\par the whole or any part of the master plan, if
\par necessary. at the expiry of every five years in
\par accordance with the procedure prescribed by the Act
\par and these rules as if the proposed amendment were a
\par new master plan.
\par
\par \tab Provided that if the Authority is of the opinion that
\par having regard to the circumstances prevailing at any
\par particular time it is necessary so to do, it may amend
\par the master plan or any part thereof at any time prior
\par to the expiry of the said period, in accordance with
\par the aforesaid procedure.
\par
\par \tab Provided further that the Authority may, without
\par following the aforesaid procedure, but with the prior
\par approval of the Central Government, permit on receipt
\par of an application in this behalf, any change in the
\par size of public parks and recreation grounds not
\par exceeding ten per cent either way of the approved
\par size.
\par
\par 13. Approval of Central Government to amendment of
\par master plans - (1) amendment of the master plan shall
\par take effect unless approved by the Central Government.
\par (2) Immediately after an amendment has been approved
\par by the Government the Authority shall publish it in
\par such manner as may be prescribed by regulations a
\par notice stating that the amendment has been approved
\par and naming a place where a copy of the amendment may
\par be inspected at all reasonable hours and upon the date
\par of the first publication of the aforesaid notice the
\par amendment shall come into operation.
