Sub: Request to receive information (for
rectification) of omission under s.4(1)c of Right To
Information Act, 2005, viz, non-publication of
relevant facts pertaining to decision to host on
18.10.05 a study visit for senior officers of the
armed forces from the LDMC course at College of
Defence Management, Secunderabad

Sir,

Among RTI Act provisions that came into force on
15.06.05 is: "4 (1) Every public authority shall - ...
(c) publish all relevant facts while formulating
important policies or announcing the decisions which
affect public".

According to the news item under reference, "An
officer of the rank of major general and 10 of the
rank of colonel will Delhi Metro on Tuesday... to
learn about its management style ... they will first
spend an hour with the Managing Director ... be taken
to the Central Secretariat metro station and from
there they will board an underground train... The next
stopover will be at the Operational Control Centre
(OCC) at Shastri Park... Then at Shastri Park Depot
the officials will be given a feel of what goes on
behind the scenes... in the culminating phase, the
officials would carry out project studies to find
solutions to the challenges being faced by the defence
services...".

I have not been able to locate on DMRC website any
published facts pertaining to its decision, announced
by the press on 18.10.05, to host this visit to,
primarily, Shastri Park on 18.10.05.

You are requested to receive this communication as
information of omission under s.4(1)c of the RTI Act,
2005, and you are requested to rectify the said
omission by publishing forthwith on DMRC website all
relevant facts relating to the said decision, which
affects public on account of the following:

(a) Shastri Park is central to WP (C) No. 6500/2005
(Gita Dewan Verma v/s DMRC & Ors), in which DMRC's
plans for further development on the site have been
stayed and counter-affidavits filed reveal gross
illegalities in all prior development. The matter is
listed for hearing by the Hon'ble High Court on
19.10.05.

(b) Shastri Park is the site for which DMRC had
approached the Hon'ble Court last year for directions
for encroachment removal, claiming urgent public
utility work, after a representation for stopping its
own illegal construction there was forwarded for
appropriate action to its chairman by Hon'ble
President of India, who is also the Supreme Commander
of the Armed Forces.

I believe an impropriety has occurred and I do not
believe that the College of Defence Management would
have participated in it knowingly. Nor is this the
first time that DMRC has, in effect, misled our
premier institutions. In my afore-mentioned petition
it has become clear how DMRC veritably manipulated
conceptual / provisional clearances from DUAC, CWC,
etc, and then misused these to claim their approval of
its illegal commercial constructions at Shastri Park.
This propensity affects us because it undermines the
credibility of our premier institutions, including
DMRC itself.

I also request that you let me know forthwith: (a) if
you have any hesitation in publishing this
information, and (b) fee/charges for processing this
request, as I am unaware of Rules relating to s.4(1)c
of the RTI Act.
