[mpisgmedia] JNNURM Tender for EoI for CDPs: Request for information

Dear Sir,

Please refer to JNNURM Tender inviting by 19.12.05 EOI
from established firms and institutions who have
experience and interest in preparation of City
Development Plans (CDP), at:
http://urbanindia.nic.in/moud/what%27snew/main.htm

I am a qualified and experienced planner desirous of
making consultancy offers to city planning authorities
as well as to international firms that are expected to
participate in JNNURM in view of decisions to allow
100% FDI in real estate development and to include
urban planning services in offer for WTO-GATS. I
expect that several experienced planners in the
country wish to make similar offers and appreciate the
head start provided to domestic planning professionals
by MoUD Tender before entry of foreign urban planning
firms pursuant to GATS.

However, the Tender is not accompanied by sufficient
information to allow planners to make competitive
offers / firms to respond with considered EoIs. On the
assumption that the Tender is not intended merely to
confirm the private-sector willingness that JNNURM and
FDI /GATS decisions presuppose, I request publication
on MoUD website of the following clarifications, which
I believe also fall in ambit of s.4 of RTI Act, 2005,
since they will make for transparency in JNNURM.

1. Full list by name and state of cities covered by
JNNURM

2. Legal framework governing CDPs in each of the
cities covered by JNNURM, including:
(a) Full list of laws including state planning Act,
city development Act, etc, governing preparation and
revision of the city Plan (by whatever name), with
text of the bare Acts.
(b) Status of the statutory city Plan in terms of
dates of notification of original and revised
versions, with text of current Plan.
(c) Status of statutory sub-city Plans (including
Zonal plans, Special Area Plans or any other such
plans) arising from and duly notified pursuant to
notification of the current statutory city Plan
(d) List of city, state and central authorities with
statutory roles in respect of the city Plan, with
relevant provisions of the Act and rules, regulations
and the Plan formulated thereunder.
(e) Statutory provisions for private-sector and public
participation in the city Plan and in authorities for
it, including provisions of the Act and rules,
regulations and the Plan formulated thereunder.
(f) Statutory provisions (in development planning law
as well as in municipal law) pertaining to the role of
the municipality in respect of the city Plan
(g) Status of progress on adoption of the model
municipal law, with text of the specific Bill / Act.

3. Details, in terms of the following, of formulation
of the illustrative "Tool Kit" for "Formulation of a
City Development Plan" under JNNURM that is posted on
MoUD website at

(a) names of experts / consultants involved in this
formulation (since it envisages an approach to CDPs
that is at variance from the commonly practiced
approach to preparation and revision of city Plans)
(b) details of concurrence on this formulation of
Council of Architecture (statutory authority for
regulating private practice, presumably also in
respect of Urban Planning since GATS offer requires
incorporation as Architectural Firm for urban planning
services in Mode-3) and Institute of Town Planners
India (non-statutory agency that has a code for
professional conduct for members)
(c) details of / links to details of pilot-projects
wherein the approach proposed in the Tool-Kit
formulation has been successfully demonstrated

4. Explication of the following in regard to the
Tender:
(a) reason for short duration tender (up to 19.12.05,
for a scheme launched only on 03.12.05)
(b) the "set of criteria" according to which MoUD will
be vetting EoI received
(c) reason for MoUD vetting EoI and short-listing
names to "be commended to state and city governments
for their guidance and consideration" and whether
State and city governments inclined to access JNNURM
funds without CDPs arising from this Tender will be
considered at par with others

5. Confirmation of the following in respect of the
Constitution of India:
(a) exactly how is MoUD empowered by the Constitution
to launch and implement a 1 lakh crore JNNURM in a
manner involving its direct intervention in
identifying both the parameters and the private firms
for preparation of CDPs pre-required for accessing
JNNURM funds
(b) exactly how is a comprehensive city planning role
(rather than merely plan implementation role) being
read for municipalities in the 74th Constitutional
Amendment (since questions about this have been raised
time and again in the planning fraternity, notably at
the AUMDA conference in 2003)

The above clarifications will also help explain the
reference in JNNURM launch advertisement to that
desire of Pt Nehru which led to enactment of Delhi
Development Act and preparation of Delhi Master Plan
that became model for city Plans across the country.
Details of JNNURM revealed thus far suggest a contrary
articulation of city planning and claim of its basis
in the vision of Pt Nehru is perplexing.
