The Bill has in s.172 a saving clause that makes undertaking of project by
Mplty or by any other agency (pvtzn) subject to state law relating to
planning, development, o&m and management of municipal infrastructure and
services. And chapters on Planning (XII & XIII) empower at Mpl level
without tampering with per se the planning process (including permissions
for layouts or building) and embed Mpl plg in metropolitan planning (and
save for certain phrasing, including city development plan, I would not
say they are unconstitutional in terms of the 74th).

Theoretically, this allows pvtzn while enabling prevention of bad prvtzn.
In reality it will allow locking-in bad pvtzn, in cake-walk only because
in recent years endless capacity-building exercises have all but atrophied
municipalities and endless participatory-planning discourse has all but
eliminated planning frameworks. Cant blame (or credit) just USAID for
that!
