CDP land for industrial units illegal: HC

The Karnataka High Court on Tuesday declared as illegal use of lands,
particularly earmarked for residential, civic amenities and other purposes
in the Comprehensive Development Plan (CDP), to set up "industrial areas".

In its landmark judgement, the Court held that the Karnataka Industrial
Areas Development Board (KIADB) cannot make use of lands, earmarked for a
specific purpose in the CDP, for industrial purposes without seeking
revision of the CDP...

An area earmarked for a specific purpose in the CDP by the planning
authority remains as such on the record but practically the same area
would be put to use for different purposes if the KIADB was allowed to
declare an area as "industrial area" without seeking permission for change
of land use, the Court said. Use of land for purposes other than that is
earmarked in the CDP would be contrary to the KT&CP Act, the Court held.

The Court was dealing with petitions challenging the acquisition of land
by the KIADB to allot it to a private company to establish an Information
Technology park near Outer Ring Road, K R Puram in Bangalore.
