DDA gets HC notice over slum dwellers

ASSERTING THAT those living in jhuggis are indispensable service providers to the affluent and middle class sections, the Delhi High Court has directed the DDA to prepare a "timebound scheme" to resettle 200 families who were evicted from the Vasant Kunj area in the Capital. Justice Mukul Mudgal also asked the vice-chairman of the DDA to file a compliance report to the court within two months and posted the matter for further hearing to September 22. The court also directed the DDA to consult the victims before evolving the scheme of con structing Lower Income Group (LIG)/Economically Weaker Sections (EWS) and also publicise it widely so that families which had scattered to different parts of the city after the evictions were benefitted by the scheme.
Justice Mudgal passed the orders on a batch of petitions filed by the evicted dwellers of Arjun Camp, Pocket B-P, Vasant Kunj, challenging the DDA's action in evicting them from the place. The petitioner Jagadish and others alleged that over 200 families were evicted by the DDA on May 19, 2003 even while a petition challenging the proposed move was pending before the court. It was contended by the petitioners that the evictions were illegal and in violation of their Fundamental Rights guaranteed by the Constitution. The petition further submitted that it was the duty of the DDA to construct EWS/LIG houses for poorer sections of the society as stipulated by the Master Plan for Delhi(MPD), 1962.

The evicted persons complained that they belonged to the economically weaker sections of the society and it was the State's duty to provide them shelter and proper living facilities. Upholding the victims contention Justice Mudgal observed, "It is the apathy of agencies like DDA which is one of the major cause for rise in the number of slums" The court noted that while genuine beneficiaries of the low cost housing schemes were being evicted from slums, persons not eligible for the EWS/LIG have encroached the same.
