*Mumbai, July 26:* IN a Public Interest Litigation on the non-allocation of
funds for the National Urban Renewal Mission (NURM), the Bombay High Court
on Wednesday ordered both the State and the Centre to specify the time
required for sanctioning the funds withing three weeks.

Senior counsel Iqbal Chagla, who appeared for petitioner Saleh Doctor, said
both the State and Union governments and the Brihanmumbai Municipal
Corporation (BMC) allocate the annual Rs 650-crore fund for NURM.

year, only the BMC has allocated Rs 280 crore for Phase I of a project
regarding infrastructure upgradation of Mumbai.

To the court observations that the fund flow should be steady, the State and
the Centre sought time citing practical difficulties.

Additional Solicitor-General B A Desai, representing the Centre, said: ''The
State has to give a proposal to the Centre which will be considered by the
Planning Commission. The Centre can allocate funds only after the State
prepares a scheme. The money cannot be allocated randomly.''

Meanwhile, the BMC told the court that 33 contractors, who were found to be
errant while laying drainage system and constructing roads, have been
penalised.

The court, however, taking strong objection for the fact that only Rs
5.4lakh was fined from 33 contractors, said the fine is just a token
amount.

However, senior counsel K K Singhvi explained that this is just a beginning
and more action will follow.

The court also ordered the civic body to file an affidavit on the
implementation of the Brihan-mumbai Storm Water Drainage (BRIMSTOWAD)
report.
