After MUD Expert-Committee on unauthorized
construction and misuse / TKC and MUD Expert-Committee
on Farmhouse & Unauthorised Colonies of the Affluent,
the latest MUD Expert-Committee on Lal Dora has issued
public notice inviting views of the public (HT,
28.08.06, p.12)
These MUD exp-coms have many commonalities. A striking
one is the consistent violation of the Architects Act
in the choice of experts for public causes.
TKC had EFN Ribeiro, against whom the Council of
Architecture proceedings were pending (CoA had already
judged him guilty of professional misconduct and was
in the process of deciding penalty).
The Farmhouse Committee has EFN Ribeiro as well as AGK
Menon, with reference to whom the CIC has directed
review of the Committee in the appeal by Samay Singh
re failure of MCD and DDA to furnish information of
any building permissions for TVB School of Habitat
Studies, architecture college functioning from a sort
of farmhouse with AGK Menon as Director (and EFN
Ribeiro as, formerly, Chairman of Board of Studies).
TVB-SHS / AGK Menon have been trying for land use
change / regularization in MPD-2021 and for AGK Menon
to have agreed to be on the Farmhouse Committee (and,
before that, on an expert group for the MPD-2021)
prima facie amounts to misconduct under the Architects
Act.
The Lal Dora Committee has Jamal H Ansari, Retd Acting
Director SPA, named in the MUD public notice as an
Architect. Ansari is not qualified as architect (he is
qualified as engineer and as planner). So he is not
registered as architect and not listed in the
directory of registered architects. The use of title
of architect for/by him is prohibited by s.37 of the
Architect Act.
These extra-legal public notices inviting members of
the public to *share their views* with such experts
appointed to extra-legal committees are obnoxious
invitations for complicity in violation of law
governing the profession to subvert the law governing
development. I think members of the public ought to
write to CoA and cc their letters as responses to the
public notices or vice versa.
