53O. Elector deciding not to vote :-


If an elector, after his electoral roll number has been duly
entered in the registered of voters in Form 11 A and has put his signature or
thumb impression thereon as required under sub-rule (1) of the 53 L, decided
not to record his vote, a remark to the effect shall be made against the said
entry in form, 11 A by the presiding officer and the signature or thumb
impression of the elector shall be obtained against such remark.

Procedure is available on ECI website for the comparable
Rule Rule 49O of the Conduct of Election Rules, 1961, for Assembly & Lok
Sabha elections (Elector proceeds to get ink mark. Then, instead of proceeding
to EVM informs Presiding Officer of decision not to vote. Presiding Officer
records the decision in the register of voters, ie Form 11A in DMC (EoC) Rules. Elector signs
against the entry, and leaves).

btw: After receiving complaints from electors that polling
officers could not assist/guide electors deciding note to vote in the Lok Sabha
elections in 2004, ECI had issued an advice to all state and UT Chief Electoral
Officers about ensuring that polling officers are adequately informed. ECI also
issued a further letter in this regard to CEOs in the three states that went to
poll in 2007. The question as to whether Rule 49O needs to be publicized among
electors in terms of s.4(1)(c) of RTI Act is pending decision in a complaint
petition to the CIC naming ECI. Request on same lines has been made to Delhi
State Election Commission about Rule 53O
