[mpisgmedia] DMRC Public Notice re EIA for Ph.2 / RTI requests

Dear Mr Dayal,

Please refer to DMRC Public Notice published on p.8 of
Hindustan Times dated 06.01.06. This is issued in your
name, invites suggestions on Phase-2 EIA report and
says the EIA report is available on DMRC website.

1. I am not able to locate the EIA report on DMRC
website. As an imperative of s.4(1)(c), besides claim
in your Public Notice, please ensure publication with
link from main page, etc.

2. Your Public Notice does not specify the statutory
provisions under which you have issued it or by which
you will process the suggestions invited. Kindly
ensure that website publication under s.4(1)(c) is
complete in this respect.

3. In case of delay in website publication, and if
convenient also otherwise, kindly send me a copy of
the report. I believe I can request this under
s.4(1)(d) of RTI Act as affected person in regard to
your decision to invite suggestions from public on an
EIA report, in view of the following:
(a) DMRC has not disclosed in my pending writ petition
the procedures it follows for EIA
(b) You have not answered my RTI requests about
procedures for public participation in metro related
decisions

4. While searching for the EIA report on DMRC website
I noticed that the What-is-New section has an item on
the IT Park inauguration on 02.04.2005, with
photographs of dignitaries as well as the one of the
building that is posted also on the updated property
development page. With reference to that I had made,
vide my eml dated 02.01.05, requests under s.4(1)(b)
and s.4(1)(d) of RTI Act and for confirmation right
away of rejection of my prior requests under s.4(1)(c)
vide emls dated 18.10.05, 25.10.05 and 08.11.05. My

I await your response, with urgency in view of your
Public Notice as well as of news reports of some
objection now (after approvals and hearing, etc) to
the DMRC-proposed financial plan for Kochi metro.

I have been wondering if there might be an error in
your eml id as published on the website, but the same
is published also in your Public Notice. I assume,
therefore, that my emls have reached you. For your
convenience, I will also dispatch text of this eml by
courier. The only reason I can think of for you not
having acknowledged or replied to my emls is that
perhaps DMRC has some sort of exemption from RTI Act.
If that is the case, please let me know.
