In the PIL filed in 2003 by an mpisg convenor for
enforcement of master plan provisions for villages in
mehrauli-mahipalpur area and stopping unplanned
illegal projects using up land and water needed for
them, High Court DB of J Virender Jain has directed
MoUD to file reply by next hearing and that the matter
be listed along with the mpisg PIL (filed in 2002
jointly by all mpisg groups in vasant kunj area)
against unfettered disposal of planned commercial
sites in residential schemes, listed on 5 april.
Earlier today the batch of matters relating to
unauthorised constructions came up and was adjourned
to 2 pm tomorrow. Like the matters relating to the
business of free seats in schools these seem to need
larger courtroom. MIB were flowing way out and those
inside took long moments to stream out.
By comparison our hearing was most dignified. Anupam
Lal Das succinctly put across our case, opposite
counsel were most attentive and Lordship was very firm
about MoUD failure to reply. Anupam also mentioned
that MCD counter-affidavit claimed no role in the area
but Mehrauli-Mahipalpur road was listed in its Public
Notice pursuant to Supreme Court orders. Lordship
gently observed that MCD perhaps itself does not know.
We hope MCD reads in that some reassurance amidst
endless media tirade to conjure a court v/s MCD
situation in PIL matters that, by definition, are
meant to be non-adversarial. And we do look forward to
hearing from MoUD - on affidavit. (it has also not
filed reply since 2002 in the commercial use matter)
by way of further evidence of worth of MIB, I got (a)
lift back from passing cab-driver who is client of
Anupam in the Arjun Camp matters with stop-over for
juice at client of Ruksana in the commercial use
matter and (b) for my memoirs Anupam-case of
invaluable ethereal MIB-practice of arriving before
matter in court to, er, stare.
