Govt changes to Master Plan sought to be quashed

On Wednesday former Chief Secretary of Delhi, Omesh
Saigal approached the Delhi High Court seeking the
quashing of the September 7 Government notification
amending the Master Plan 2001 claiming that it had
been drafted without considering the ramifications it
would have on the civic infrastructure of the city.

Coming up for hearing before the Division Bench of
Acting Chief Justice Vijender Jain and Justice Kailash
Gambhir, the petitioner contended that the Government
notification of September 7 bypassed the sealing and
demolition orders upheld on various occasions by the
Delhi High Court and it would affect the quality of
life in the Capital. Also, the proposal of the
National Planning Board to regulate migration to the
Capital by developing the surrounding areas would take
a backseat, he reiterated.

Though the petitioner pleaded for an interim stay and
quashing of the notification, the Government counsel
brought to the notice of the court that in view of a
similar petition filed in the Supreme Court, he would
need time to seek a clarification. Meanwhile, the
Bench posted the matter for further hearing till
September 15.

Meanwhile, in the Supreme Court another petition was
filed by Delhi Pradesh Citizen Council challenging the
two Government notifications of July 21 and September
7, 2006, legalising all commercial activities in the
residential areas of Delhi in its bid to give relief
to traders who were facing the prospect of sealing of
their commercial premises in Delhi. The petitioner has
contended that by notifying 1979 roads in the city for
permitting mixed land use, the Government has made yet
another attempt to nullify the orders of the Supreme
Court by legalising all illegal commercial activities
being carried out by law breakers in the Capital.

The petition has sought directions to declare the
impugned notification dated July 21, 2006 and
September 9, 2006 issued by DDA and Union Urban
Development Ministry respectively as illegal and ultra
vires of the Constitution. The petitioner has made the
