Delhi Master Plan 2021: Gearing up for public
participation through Public Notice
IDGAH PUBLIC NOTICE
02.06.2003, 6:30 PM, IIC Conference Room 2

Ministry of Urban Development has issued a Public
Notice on 06.05.2003 calling objections and
suggestions on its proposal to ?change the land use of
an area measuring an area of 2.61 ha, from residential
to extensive industrial with leave to set up a ?H?
category Unit, i.e. Abattoir House at Idgah?

THIS MEETING IS FOR THOSE INCLINED TO RESPOND TO THIS
PUBLIC NOTICE.

This meeting WILL NOT discuss problems on account of
industries and abattoir in the historically
significant Idgah / residential area, as it is assumed
that those participating agree there are problems.
This meeting WILL NOT discuss solutions for the
specific site, as the Public Notice is defective to
the extent of not providing details. This meeting WILL
NOT debate issues outside the purview of the Master
Plan, only a document of entitlements in use of city
space, and modification thereof vide this particular
Public Notice.

This meeting WILL ONLY identify points of techno-legal
lapses to try and effectively respond to the Public
Notice, irrespective of varying ? even conflicting ?
concerns from which we wish to respond.

Since the Public Notice relates to the Master Plan and
its enabling legislation, effective response to it
must focus on this statutory regime. A starter
presentation on this will be made (see outline below),
and further points, in the same domain, will then be
invited. Additional (other than Master Plan related)
points for responses will next be discussed ? not for
their content but only with a view to ascertaining if
they will contribute to effectiveness, not
obfuscation. (View this, if you please, as a tactical
battle in whatever war you are engaging on).

The Idgah Public Notice is dated 06.05.2003 and allows
30-days for filing objections and suggestions.
Technically 04.06.2003 can be considered last date.
The meeting seeks commitments for filing / mobilizing
responses in the following two days and also
volunteers for facilitating the same. A sheet will be
circulated for this.

It would be useful for follow-up to place together in
the public domain as many responses as possible. Those
willing can mail their responses to me at
mpisgplanner@xxxxxxxxx and I will post them on the
Delhi Master Plan 2021 Minder on the web.

In view of the foregoing, the following agenda is
proposed for the meeting:
6:30: all, who haven?t already received it, to read
this note
6:40: my starter presentation of response on Master
Plan grounds
7:00: suggestions for specific Master Plan related
additional points
7:10: suggestions for specific (especially legal)
points on other concerns
7:30: all to consider if they wish to respond within
this framework and commit / volunteer (sign-up)
7:40: decisions about logistics / details of filing
responses in the next two days

Outline of plannerly response:
1. Objection to defects in the notice (clarifications
sought about which have not been received)
(The notice is in contravention of prescribed rules
and appears to be beyond jurisdiction. It fails to
provide or direct public to information for meaningful
scrutiny or informed comment or even plausible
assurance of careful consideration in the context of
ongoing court and policy developments. The further
failure to respond to clarifications about defects
suggests an objectionable lack of transparency
contrary to purpose and spirit of Public Notice
process)
2. General objection to the modification (evaluating
validity/worth in relation to the Master Plan)
(The modification jeopardises rather than furthers
sectoral goals of the Master Plan in respect of
residential use, industrial use and walled city and
its overall goal of fostering conflict-free society
through compatible land use planning, without any
obvious need to downsize these goals / entitlements
flowing from them. The modification is in
contravention of the purpose of powers for Plan
modification).
3. Suggestions
(To withdraw the particular proposal pending holistic
consideration of sectoral needs in the imminent
revised Plan and to ensure in general adequate
transparency to make Public Notice process meaningful)
